The information held in the database is provided by the members, and GREEN THEME INTERNATIONAL makes no warranty, either expressed or implied, about the information provided. The entire contents of the database and web-site are Copyright of GREEN THEME INTERNATIONAL. All rights reserved. No parts of this web-site or associated documentation and data may be reproduced in any form without written permission from GTI.
2. GTI is an introduction agency. Accordingly, neither GTI nor its Representatives offer any guarantee and make no warranty that the Property owner or Agency will find a suitable Renter for the Property. The membership fee is paid on a non-refundable basis.
3. It is not possible for GTI or its Representatives to inspect the houses of Property owners and Agencies registered with it. Accordingly neither GTI nor its Representatives accept any responsibility or liability for the quality, fitness for purpose or state of the Property, nor can GTI or its Representatives accept any liability for any damage, accident or injury which might occur to the Renter or any member of his family, or any person accompanying the Renter to the Property owner's home, or to whom the Renter allows access whether as visitor, tradesman or otherwise.
4. Neither GTI nor its Representatives are responsible for agreeing the terms and conditions of any agreement between the Renter and the Property owner or agency, subscribers, or other users of information provided on this web-site. Any such agreement is a matter between the Renter and the Property owner or agency, whether as to such terms as allowing the Renter into the property owner's home, or any accident or damage which may occur to either home or any person occupying or visiting either home during the rental period, or the giving up of possession at the end of the rental period.
5. Only the Renter is aware of his/her own particular circumstances and requirements, and accordingly only they can agree terms suitable for their needs and circumstances. Neither GTI nor its Representatives accept any responsibility or liability for any agreement (or lack of it) between the Renter and the Property owner or agency. If the Renter has any concerns or doubts about, or does not fully understand any term of any agreement or proposed agreement between himself and the Property owner or agency the Renter should seek professional legal advice about such agreement or proposed agreement.
6. The Property owner or Agency is solely responsible for ascertaining if the Renter, his family and any persons accompanying him for the Rental period are suitable and trustworthy persons to allow into occupation of the The Property. The Property owner or Agency is recommended to ask for references if appropriate. Neither GTI nor its Representatives accept any responsibility or liability for any acts or omissions of the Renter, his family and any person accompanying him whilst in occupation of the Property owner's home.
7. The above stated TERMS AND CONDITIONS shall be construed in accordance with the laws of England and Wales. By maintaining individual membership of GTI, members consent to the subject matter and to the jurisdiction of the English courts.
8. These Terms and Conditions of individual membership and home exchange, including but not limited to all applicable fees, may be changed from time to time by GTI at its sole discretion. Members will be provided advance written notice of any such changes.
1. Neither GTI nor its Representatives can be responsible for any damage, crime or accident to or at the Property owner's home, and the Renter is solely responsible for all damage caused by him or his family or anybody accompanying him during the rental period, or whom the Renter allows to enter the property owner's home whether as visitor, tradesman or otherwise. Accordingly, the Property owner is strongly recommended to check that he has or obtains adequate insurance for his home, and that the terms of any home insurance policy will provide insurance against all usual risks during the period of the Renter's occupation of the property. The Renter is also strongly recommended to ensure that he has, for himself, his family and anybody accompanying him, adequate third party and public liability insurance for the period of the occupation of the property owner's home, to provide cover in the event of any damage thereto, or any accident to any person entering or occupying the property.
2. The Renter is strongly recommended to obtain adequate travel insurance for the rental period, to provide cover for the Renter, his family and any person accompanying him for the rental period for all normal travel risks including delay, cancellation, loss or damage to possessions, accident, death or injury including medical expenses, and any duty the Renter may owe or possible liability to the Property owner or agency.
3. The Renter should check the bona fides of the Property owner or agency, his authority to allow the Renter into the property owner's home and trustworthiness. If appropriate the Renter should require evidence of the Property owner or agency’s authority into his home and references to establish the Property owner or agency’s bona fides.
4. If the Renter is in doubt about any terms of any agreement with the Property owner or agency or the Property owner or agency’s bona fides or authority to enter into such agreement the Renter should seek appropriate legal or other professional advice.
In the preceding Terms and Conditions, and Recommendations, the following terms and expressions shall have the following meanings:-
1. "Renter" shall mean the person or persons whom the Property owner or Agency proposes to allow to occupy his home for a predetermined rental period.
2. "The Property" is the building, house, flat or property which the Property owner or agency allows the Renter to occupy, or proposes to allow to occupy, pursuant to any agreement or proposed agreement between the Renter and the Property owner or agency.
3. "The Rental period" shall mean the agreed period of time for which the Property owner or agency allows the "Renter" to occupy "The Property".
4. In these Terms and Conditions, any word or expression carrying the masculine gender shall include the feminine and vice versa and the expressions "his/hers: he/she: him/her" shall be construed accordingly.
